William Chrichlow Molyneux d. 1836

This is the last Will and Testament of me William Chrichlow Molyneux of Kirkdale near Liverpool in the County of Lancaster Merchant but about to proceed to Savannah in the United States of America. I direct all my just debts to be paid out of my personal and also my real Estate if my personal Estate is insufficient. I give and bequeath the gold watch which I now wear together with the chain seals and other appendages to my dear Mother and I give devise and bequeath the sum of fifteen guineas to Mary Irvin, spinster (the family nurse) who now resides with Philip Orton of Liverpool, gentleman, which I direct shall be paid by my Executors hereinafter named immediately after my decease or so soon after as they shall receive sufficient effects for that purpose. And I give devise and bequeath all the Estate part share and interests which is now vested in me and to which I am intitled under and by virtue of the Will of my late Father Edmund Molyneux as well as the real and copyhold as personal Estates thereby devised to or In Trust for and accruing to me And all my real and personal Estate and Effects whatsoever and wheresoever unto and to the use of my Brothers Thomas Chrichlow Molyneux, Horatio Nelson Chrichlow Molyneux and my sisters Priscilla Molyneux, Anne Molyneux, Amelia Molyneux, Maria Jane Molyneux and Ellen Molyneux their respective heirs Executors Administarors and Assigns for ever share and share alike as Tennants in Common according to the respective Estates and the nature and qualities thereof. But in case any of them my said Brothers or Sisters shall die in my life time leaving lawful Issue then I give devise and bequeath the share and shares to which such Brother or Sister so dying in my lifetime would have been intitled had he or she survived me Unto and to the use of the lawful Issue of such Brother or Sister so dying his her or their heirs and assigns for ever as Tennants in Common And in case any of my said Brothers or Sisters shall die in my life time without leaving lawful Issue living at the time of my death then I give devise and bequeath the share and shares which such which such Brother or Sister so dying would have been intitled to if he she or they had survived me unto the survivor or survivors of my said Brothers and Sisters his her or their heirs Executors Administrators or Assigns for ever as Tennants in Common And I do hereby appoint my Brothers Thomas Chrichlow Molyneux, Edmund Chrichlow Molyneux and John Chrichlow Molyneux my Executors And I hereby declare that one shall not be answerable for the acts receipts and defaults of the other or others of them but each only for his own respective acts receipts defaults and neglects And that they may compound and receive a part of the whole of ny Debt or Sum of Money due to me separately or jointly with any othe rperson or persons and refer to Arbitration and compromise any disputed accounts engagement contract or mercantile transaction into which I may have entered or in which I am interested and thereupon to give such discharges receipts and releases and abide by any Award or Awards to be made in pursuance of any reference or references as may be necessary And I hereby revoke all former Wills In witness whereof I have hereunto set my hand and seal this twelfth day of October in the year of our Lord one thousand eigth hundred and twenty

Thomas Chrichlow Molyneux and John Chrichlow Molyneux two of the Exectutors in this Will named were sworn in common {?} (Power being reserved to Edmund Chrichlow Molyneux the other Executor therein named to take upon himself the execution thereof when he shall lawfully request the same) and they further made Oath that the personal Estate and Effects within the Diocese of Chester were under the value of sixty thousand pounds

This is the last Will and Testament of me Thoams Molyneux of Walton in the County of Lancaster, made and published this twenty first day of May one thousand eight hundred and thirty three as follows. First is my Will and I doe hereby direct that all my just debts, funeral expenses and the charges of the probate of this my Will shall be paid and discharged, to the payment whereof I subject both my real and personal estate. I give devise and appoint all my several copyhold Messuages and Tenaments with the Lands and Hereditaments thereto belonging situate in West Derby and Everton in the said County in the occupation of William Tasker, Tho Revell, Anne (?) Eccersley, John Laurenson, Henry Hoskin, Bernard McEntigent (sic?) ---- McShean, Jane Gouldburn, Richard Shackerley, and {?} Daley and Kiough (?), John Orritt, Tho Orrett, Mathew Rawlinson, Tho Lawton, Wm Molyneux, Wm Kerr, Benjamin Hallows, as tenants thereof, and also the Sandy Croft, and the higher Schofield in my own possession, which I have surrendered to such uses as I shall by my Will direct and also all my Freehold Messuages Tenaments Lands and Hereditaments in Walton, West Derby, Melling, Mahull, Aughton, Toxteth Park and Liverpool in the said County, in my own possession and in the several occupations of John Orrett, Robert Masker, ---- Harratt, Mathew Rawlinson, Tho Orritt, William Brookfield, James Bolton, James Bradley, William Hudgson, Robert Ashcroft, Benjamin Hallows and in Liverpool in the occupation of Francis Ashley Ho and John Fox and others or in whose possession the same may be. Apart of which said Messuages and Land in Walton and West Derby are comprised in the Settlement made upon and previous the marriage of my son Anthony with Francis Blayds his present wife, which Interst in several Closes of Land in Melling in te said county in the occupation of ----- Barnes as Leasehold tenant thereof. And also the House, Garden and Land in my own possession in Walton, with the Gardeners Cottage and Garden in West Derby, my three seats or pews in West Derby Chapel, one seat in Walton Church, one seat in Melling Chapel, my one seat and half seat or pew in Maghull chapel And also all other my Real Estates as well as Copyhold as Freehold and also my chattles real and also all my personal Estates whatsoever and wheresoever, Canal Shares, London Dock Stock, Government Stock, subject as aforesaid unto my eldest Son Anthony and my younger Son Edmund and my Son in Law Thomas Littledale, To hold to the use of them their Heirs Executors Administrators and Assigns, according to the nature and quality thereof upon the Trusts hereinafter declared of and concerning the same that is to say . As to my Wines, Liquors and provissions of every denomination in and about my House at the ime of my death, and also as much of my Household Goods, Plate, Linen and china and furniture, as my son Edmund and my dear daughter Sarah may deem necessary for the comfortably furnishing a suitable House for themselves, I give and bequeath the same to my Son Edmund and my daughter Sarah and their assigns absolutely for ever. And as to the remainder of my Wines, Liquors, Household Goods, Plate, Books, Pictures, Coach, Horses, Cows, Cattle, Farming Stock and furniture of whatsoever denomination I give and bequeath to my son Anthony and his assigns absolutely and for ever. And I direct my said Trustees, as soon as they have it in their power, out of my Personal Estate. pay to the Trustees named in the settlement made previous to the solumnization of Marriage of my late daughter Ann and Mr Thomas Littdale, being the sum of six thousand pounds which I have therein engaged to pay, and to be taken in discharge thereof, subject to such Trusts provisions and agreements as therein contained and to no other trusts or purposes whatsoever with interest for the same from the time of my decease, at the rate of four pounds per cent per annum. And also the sum of six thousand be paid to the Trustees named in the settlement made previous to the solumnization of Marriage of my daughter Mary and the Revd Edward Royds, being the sum of six thousand which I have therein engaged to pay, and to be taken in discharge thereof, subject to such trusts provisions and agreements therein contained and to no other Trusts or purposes whatsoever, with interest for the same from the time of my death, at the rate of four pounds per cent per annum. And I also direct the sum of six thousand pounds to be paid to the Trustees named in the settlement made previous to the solumnization of Marriage of my daughter Ellen Watson, and Mr John Blayds being the sum of six thousand pounds which I have therein ingaged to pay, and to be taken in discharge thereof, subject to such trusts provisions and agreements as therein contained and to no other trusts or purposes whatsoever. With Interest for the same from the time of my death, at the rate of four pounds per cent per annum. And I also direct the sum of six thousand pounds be paid to my daughter Sarah for her sole and separate use, with Interest for the same from the time of my death at the rate of four pounds per cent per annum. And I direct my said Trustees within twelve calendar months after my decease to surrender and convey to my Son Anthony his heirs and assigns my Estates in West Derby and Walton known by the name of Newsham Farm in the occupation of John Oritt and others, also the House and Land, in Walton and West Derby in my own possession. Also the Land and Buildings known by the name of Green Lane House and Farm in West Derby late Rigby's, and the copy hold Land purchased from Hugh Taylor. Also the Land purchased from the Trustees of the late Nathaniel Milner also the Cottages and copyhold Land purchased from the Executors of the late Will Stanishat (sic?) with the appurtinances held therewith and belonging thereto, in the occupation of Mathew Rawlinson and others, some perts of which are subject nevertheless to the Trusts and provisions contained in his marriage settlement. Als my two fields of Copyhold land purchased from Arthur Heywood Esq and the two fields of Copyhold Land purchased from the divisees of the late Mrs Stavirt, Also the Copyhold House and Land purchased form John Eden Esq with a seat or Pew in West Derby chapel, Also the two fields of Freehold and one field of Copyhold Land purchases from the Trustees under the Will of the late Edmund Rigby Esq in the occupation of the respective Tenants. Also my other Estate in West Derby known by the name of Wallhill with the Land and Buildings thereto belonging and appertaining, And also the Land and Building purchased by me form the late Robert Newal, And also the Land purchased from the Executors of the late John Fazackerly, And also the two fields of Freehold Land purchased from the Trustees of the late Peter Rigby Esq and also the Old Smith and Garden in the Town Row West Derby purchased from the divisees of ----- Lunt, now in the occupation of Tho. Orritt Thomas Lawton and William Molyneux, Also my two seats or Pews in West Derby Chaple and my one seat or Pew in Walton and also ny New Vault or Burial place under the same. And also my Freehold estates in Aughton, with the appurtinance in the occupation of Robert Ashcroft and William Hodges as Tenants thereof, Also my Freehold Estate in Toxteth Park purchased from the assigns of Robert Kitchen and now in the occupation of James Ashcroft. I do hereby direct my said Trustees to surrender and convey such last mentioned Estates in Walton, West Derby, Aughton and Toxteth Park to my son Anthony his Heirs and assigns for Ever. And as to my Copyhold Estate in West Derdy and freehold field in Everton, known by the name of Low Hill Farm with the appurtenances thereto belonging, And also the close of Land adjoining purchases from the late Richard Wright, And also three fields of Copyhold Land purchased from Sarah Gleave and other Executors of the late Wright Gleave all in West Derby in the several occupations of William Tasker, Thomas Revell, John Lawrenson, H Hoskin, Jane Goulburn, Richd. Shacklady and others, And also my Freehold Estates in Melling known by the names of Martin 'oth Meadows and Quite (sic?) House Estate with the Land and Buildings thereto belonging and appurtaining respectively in the occupation of William Brookfield and his undertenants. Also my reversionary Estate and Interest in several closes of Land, adjoining the last mentioned premises, purchased from John Formby and Ellen his Wife and now in the occupation of ------ Barnet And as to my other Estates in Maghull, known by the name of Molyneux Farm and the Stewards Grounds, in the occupation of James Bolton. Also two fields also of Freehold Land purchased form the Executors of the late ---- Whally, Seedsman, and in the occupation of Misses Whalley and Brothers, with one seat or Pew in Melling Chapel one seat or Bench in Maghull Chapel in the occupation of James Bolton, and one half Seat or Pew in Maghull chapel in the pccupation of James Bradley. I do hereby direct my Trustees or the Survivors or Survivor of them within twelve calendar Months to surrender and convey my several last mentioned Estates in West Derby, Melling and Maghull (in addition to the two estates in Maghull sometime back) unto my Son Edmund his heirs and assigns for Ever. And as to my two Freehold Warehouses in Water Street with the appurtenances thereto belonging upon trust to convey the same to my Son Edmund, his heirs and assigns for Eve. And I do hereby direct my said Trustees and the Survivor or Survivors of them to pay to the respective Trustees named in the respective settlements made previous to the Marriage of my daughters Ann, Mary and Ellen Watson respectively (in addition to what I have ingaged by those settlements to pay and direct by my Will to be paid in discharge thereof) the several Sums of one thousand pounds to each, to be held by the said Trustees of such settlements respectively on the like Trusts and in like manner as the respective sums of money so agreed or ingaged to be paid by me to such Trustees respectively are settled and directed or as near thereto as circumstances will permit. And I do direct my said Trustees and the Survivors or Survivor of them to pay unto my daughter Sarah out of my personal Estate as soon as the same can be raised the sum of four thousand pounds and the Interest thereon from the time of my decease. And I do hereby direct that me said Trustees shall as soon as convenient pay to my twenty four Grand children the sum of one hundred pounds each, also that their respective parents be requested to act as Trustees for their respective children until they shall attain the age of twenty one years. And as to the residue and remainder of my Real ans personal Estate of what nature or kind soever or whatever, I direct my said Trustees, the survivors or survivor of them to stand seized and possessed thereof, In Trust for my Son Anthony hisHeirs Executors adminidtrators and assigns for Ever. And in Case either or any of my said daughters Ann, Mary and Ellen Watson shall happen to die without having any lawful issue. In that case all such several Sums or Sums of Money under their several Marriage Settlements reverting to me. I do hereby direct my Trustees or the Survivors or Survivor of them to pay the sum equally amongst her or their surviving Brothers and Sisters, and the Heirs and Assigns of such remaining Brothers and Sisters. And I declare that the Rents of my Several Estates and the dividends and yearly Income of the several other properties hereinbefore directed to be paid and conveyed (within twelve months) after my death, be considered as incident to go along with the property so directed to be conveyed. And I give devise and bequesth all and every the Mortgages Lands Tenements and Hereditaments and all such Estate Term and Interest as I am or may be seized and possessed of or entited to as Mortgagee or Trustee in any way, unto my Sons Anthony and Edmund and my son in Law Thomas Littledale and their Heirs Executors administrators and assigns according to the nature of the property for Ever and for and during all such Estate Term and Interest as I have or may have therein upon Trust and to the intent that they and the Survivors or Survivor of them his Heirs Executors or administrators shall and may convey assign transfer and dispose of the same when and as occasion may require, or as may benecessary for the purposes of this my Will or otherwise howsoever. And I appoint my Son Anthony, my Son Edumnd and my son in law Thomas Littledale as Executors of this my Will. And I do direct that they may reimburse themselves out of any Money which under the Trusts hereinbefore contained they or any of them may Sustain or be part to. And that they shall not be answerable one for the other, nor for any money they may respectively receive, nor for the failure of any Bankers, Banker or Solicitor with whom they may respectively intrusted any part of the said Trust monies nor for the insufficiency of any Security or Securities on which the same or any part thereof shall be placed, without their willful neglect or default. In Witness whereof I have to first three sheets ofthis my Will subscribed my name, and to his last sheet set and affixed my hand and Seal the day and year aforesaid.

Signed Sealed publishe dand declared by the said Thomas Molyneux as and for his last will and testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names the word "two" in the first sheet being first obliterated and the word "three" interlined the word "as" interlined twice in the second page and the words "upon trust to conveythe same" in the third page and the word "their" in the fourth being first interlined.

I the within named Thomas Molyneux make this codicil to my will.

Whereas I have letaly purchased several Closes of Land in Melling I give devise and appoint the same and all Land in Melling purchased since the date of my will to my Son Edmund Molyneux his heirs and assigns and direct that the same shall be conveyed to him his heirs and assigns for his and their own use abolutely and for ever. And as to my Messuage and Lands in or near West Derby and all the Lands tenements and hereditaments I have lately purchased being part of the Estates of the late Edmund Livesey deceased I direct the purchases to be completed out of my general personal Estate and I give devise and appoint as last mentioned all the said messuage and Lands so purchased to my Son Anthony Molyneux his heirs and assigns for ever and direct that the same shall be conveyed and ( ) to him and them accordingly. But it is my wish and I desire the same on this condition that if my Son Edmund Molyneux should wish to have the House in West Derby and the Lawn in front and the field behind (which formed Lot 7 at the sale of the late Mr Livesey's Estates) he shall have the same conveyed to him he paying to my Son Anthony Molyneux the first cost of the same excluding any expenses of attainder (?) or Improachment (?) I may have made in my lifetime but my said Son Edmunf is to make his direction whether he will purchase the same or not in three calendar months after my decease to intitle him to the same. I give to my son Edmund Molyneux such Sum and Sums of money as met be due to me at my decesae in respect of any contract for Sale of Land on or near Low Hill in West Derby for his own use absolutely. And I give to my grandaughter Emily Royds six hundred pounds to be paid in like way as described in my will as to each of my other Grandchildren and except as hereby varied I confirm my will.
